These Terms of Use (the “Terms”) govern your access to and use of templeoffineartstexas.com and any related pages or services operated by Temple of Fine Arts Texas (“TFATX”, “we”, “us”, or “our”). By visiting or using this site, you agree to these Terms. If you do not agree, please do not use the site.
1. About TFATX
Temple of Fine Arts Texas is a cultural institution based in Austin, Texas, offering instruction in Bharathanatyam, Yoga, and Indian Percussion; presenting performances; and supporting community arts programming. Tax-deductible donations are processed through our fiscal sponsor, the Kalaavidya Foundation.
2. Use of the site
You agree to use the site only for lawful purposes. You agree not to:
- copy, scrape, or systematically download our content for redistribution;
- upload viruses, malware, or material designed to interfere with the site;
- attempt to gain unauthorised access to any part of the site or its servers;
- impersonate any person or entity, including TFATX or its faculty;
- use the site in any way that infringes the rights of others or violates applicable law.
3. Intellectual property
All content on this site — including text, photographs, video, recordings, choreography, designs, logos, and the “Temple of Fine Arts Texas” name and mark — is owned by TFATX or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. You may view and share links to our pages for personal, non-commercial purposes. Any other use — including reproduction, modification, public performance, or commercial use — requires our prior written permission.
4. Photography and recording at events
TFATX performances, classes, and community events may be photographed, filmed, or recorded for documentation, education, and promotion (including on this site and on our social media channels). By attending or participating, you consent to being photographed or recorded and to TFATX’s use of those images and recordings without additional notice or compensation. If you wish to opt out, please notify the event organiser in writing in advance.
5. Classes and enrolment
Class schedules, fees, and instructors are subject to change. Enrolment, attendance, refund, and make-up policies are communicated at the time of registration and govern the relationship between the student (or the student’s parent or guardian) and TFATX. Students and guardians are responsible for arranging appropriate health, accident, and travel insurance.
6. Donations and sponsorships
Donations are voluntary and, except where expressly stated and processed through the Kalaavidya Foundation, are not tax deductible. Sponsorship benefits described on the Sponsorship Opportunities page are good-faith descriptions and may be adjusted for individual productions. TFATX reserves the right to decline any donation or sponsorship that conflicts with our mission or values.
7. Third-party links and services
The site links to third-party services we use, including (without limitation) MyDanceHall (the member portal accessed via /login), ticketing partners, payment processors (PayPal and Zelle), and the Kalaavidya Foundation. We do not control those services and are not responsible for their content, privacy practices, or availability. Your use of any third-party service is governed by that service’s own terms.
8. Disclaimers
The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, TFATX disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of harmful components. Information on the site is provided for general informational purposes and is not a substitute for professional medical, legal, or financial advice.
9. Limitation of liability
To the fullest extent permitted by law, TFATX, its directors, officers, employees, faculty, contractors, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the site. Our aggregate liability for any claim arising out of or relating to the site or these Terms is limited to fifty US dollars ($50).
10. Indemnification
You agree to indemnify and hold harmless TFATX and its directors, officers, employees, faculty, contractors, and volunteers from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the site is the state and federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date at the top of this page. Material changes will be highlighted on the site for a reasonable period. Your continued use of the site after changes take effect constitutes acceptance of the updated Terms.
